Amend Regulatory Review Act, extending the scope of the act to the PA Fish & Boat Commission
The regulatory review process provides a mechanism through which the
legislature can exercise its oversight regarding actions and policies
of executive branch and independent agencies. This oversight role is
crucial to the balance of power. Additionally, it ensures that
executive branch and independent agencies do not go too far afield of
their statutory authority
The Pennsylvania Fish and Boat Commission has taken action that has raised questions regarding the Commission's current exemption from the
Regulatory Review Act. On May 24, the Commission voted to add 99 new waters to the state's list of wild trout streams. I am very concerned
about the impact of this decision on jobs in Pennsylvania's coal
regions, because a wild trout stream designation can negatively impact
the permitting process within the stream's watershed.
I joined many of you in asking the Fish and Boat Commission to rethink
its designations and consider their impact on jobs. This effort was to
no avail. If this policy had been proposed as a regulation and subject
to the provisions of the Regulatory Review Act, affected individuals,
businesses and interest groups would have had a formal opportunity to
make public comment and have that comment considered by the legislature and the Fish and Boat Commission.
For this reason, I intend to re-introduce legislation that will subject Fish and Boat Commission regulations to the Regulatory Review Act. The effect of this bill is that future Fish and Boat Commission regulations will be subject to the same level of public and legislative review as are regulations of numerous other state agencies. The bill is not intended to impede the Commission's ability to propose regulations, but rather to ensure that the regulations are vetted thoroughly and properly before being implemented.
