The following shall apply to inspections: (1) The first inspection shall be completed within one year of easement sale; (2) A landowner shall be notified of an inspection and the inspection shall be conducted on a date and time agreeable to the county and the landowner; (3) Within ten days of conducting an inspection, the county board shall prepare a written inspection report, and if a violation is discovered, the report shall be provided to the landowner by certified mail.; and (4) The county board and the State Board may inspect the restricted land, jointly or severally, without prior notice if there is reasonable cause to believe that any provision of the deed of easement has been or is being violated. Code Ch. 102 (relating to erosion and sediment control) may use or install either: a riparian buffer or riparian forest buffer; or another option or options among available best management practices, design standards and alternatives that collectively are substantially equivalent to a riparian buffer or riparian forest buffer in effectiveness, to minimize the potential for accelerated erosion and sedimentation and to protect, maintain, reclaim and restore water quality and for existing and designated uses of a perennial or intermittent river, stream or creek or lake, pond or reservoir of this commonwealth to ensure compliance with 25 pa. code ch.93 (relating to water quality standards). A project located in a special protection watershed in a drainage list specified in 25 Pa Code 93.9 (relating to designated water uses and water quality criteria) that proposes any earth disturbance within 100 feet of a surface water shall offset any reduction in the total square footage of the buffer zone that would have been utilized as a best management practice, with a replacement buffer elsewhere along special protection waters in the same drainage list and as close as feasible to the area of disturbance at a ratio of one-to-one. Any project incorporating such an alternative shall also include other best management practices to manage postconstruction stormwater to protect, maintain, reclaim and restore water quality and existing and designated uses of waters of this commonwealth. Replacement planting costs shall be calculated using department guidance as specified in bmp 6.7.1: riparian buffer restoration of the Pennsylvania Stormwater Best Management Practice Manual. Nonpublic schools are authorized to apply to the office for grant funding to be used for the costs associated with obtaining the services of a school police officer from a list of approved vendors. A project located in a special protection watershed in a drainage list specified in 25 Pa Code 93.9 (relating to designated water uses and water quality criteria) that proposes any earth disturbance within 100 feet of a surface water shall offset any reduction in the total square footage of the buffer zone that would have been utilized as a best management practice, with a replacement buffer elsewhere along special protection waters in the same drainage list and as close as feasible to the area of disturbance at a ratio of one-to-one. Any project incorporating such an alternative shall also include other best management practices to manage postconstruction stormwater to protect, maintain, reclaim and restore water quality and existing and designated uses of waters of this commonwealth. Replacement planting costs shall be calculated using department guidance as specified in bmp 6.7.1: riparian buffer restoration of the Pennsylvania Stormwater Best Management Practice Manual. Amends the Public School Code further providing for sale of unused & unnecessary lands & buildings & for school police officers; & further providing for office for safe schools.
PLS Summary: (PN 2127) Amends the Public School Code, in grounds and buildings, further providing for sale of unused and unnecessary lands and buildings by adding municipal authorities to the scope. The bill also provides for school police officers extending the provision to any school entity or nonpublic school. If a school is located within a municipality where no municipal police department exists, the school entity or nonpublic school may enter into a cooperative police service agreement with a municipality providing full-time police coverage that is located adjacent to the school. Lastly, in safe schools, the bill adds that the office for safe schools shall have the power and duty to establish criteria for certifying approved vendors to provide school police officers to nonpublic schools for the purposes of awarding grants and to publish and post on the Department of Education's website a listing of all approved vendors. Nonpublic schools are authorized to apply to the office for grant funding to be used for the costs associated with obtaining the services of a school police officer from a list of approved vendors. Requires the Office of Safe Schools to consult with the Pennsylvania State Police in establishing criteria for certifying approved vendors and further clarifies that nonpublic schools may not apply for grant funding for any purpose other than obtaining the services of a school police officer.
