SB 1402 had an amendment filed against it today in the House. This will be another factor that may delay the passage of this penalty bill. The amendment changes the terms of Fish/Boat Commissioners to 4 years instead of the current 8. Amend Bill, page 2, line 14, by inserting after "301(a)" and (c) Amend Bill, page 2, by inserting between lines 24 and 25 (c) Terms of office and compensation.--The members shall hold office for terms of [eight] four years and until a successor is appointed and qualified. A member appointed to fill a vacancy for a period of [four] two years or less may be eligible for appointment to a full [eight-year] four-year term. A member who serves a full [eight-year] four-year term or fills a vacancy for a period of more than [four] two years shall not be eligible for reappointment to the commission until a period of [eight] four years expires. The members shall receive no compensation for their services but may be reimbursed for travel expenses. When performing any function on behalf of the commission or acting within the scope of their official duties, members of the commission shall be authorized to operate Commonwealth vehicles and watercraft and shall be treated as employees of the Commonwealth for the purposes of automotive and general liability and the act of June 2, 1915 (P.L.736, No.338), known as the Workers' Compensation Act. * * * 2012/90MSP/SB1402A13731 - 1 -

I thought the terms were staggered so that no sitting Gov could appoint all commissioners unless he filled an 8 year term? That protects sportsmen and women kind of like the way our SCOTUS is set up.

Both are Title 30, so yes.

OK. I kind of thought some amendments being offered recently were being stalled for not being germane, even if under the same title because they were adding other sections and not directly dealing with the bill that was offered.
Simply, if an amendment was offered that didn't have something to do with original intent of the bill; they were not allowing it to be amended. I guess that answer is when it fits what they want to do.

Sent an email this morning opposing the shorter limits.
I am writing to oppose the Heffley amendment on SB 1402 that would change the term lengths of fish and boat commissioners. I do support an amendment changing terms from indefinate to 8 years, but 4 years is too short a time.
All it would take is one anti-hunting / fishing Governor to adjust things to his line of thinking and it would spell trouble. Additionally, the learning curve for a commissioner is much like what you all experience in your freshman terms.

Email went to the entire house. I had several members agree, and I hope leadership is trying to get the amendment withdrawn.

SB 1402 Alloway, Richard (R) (PN 2415) Amends Title 30 (Fish) to make extensive editorial revisions, provide for the grading of damage to property, and to detail powers and duties of conservation officers. Details the offense of unlawful use of a computer and also provides for accomplice liability and prosecution. Those participating in education programs are not required to possess a fishing license. Further provides for licenses, licensing fees, and the lawful operation of boats and boating devices. Penalties are also detailed.

He had every right to be upset....but that doesn't mean it was right to try to kill another good bill. Too much testosterone and egos in the political mix....and exactly why we don't want emotions to be the controling factor when it comes to wildllife management!

I think Pyle did the calculations. Made a statement, and still got the bill passed.
